These Terms of Service ("Terms") govern your access to and use of the applications, website, and services (collectively, the "Service") provided by Smart Tecnologia da Informação LTDA ("Smart TI", "BotBot", "we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
BotBot is a customer-messaging platform that lets businesses connect their WhatsApp Business Accounts and other Meta assets to send and receive messages, manage message templates, and communicate with their own customers through the WhatsApp Business Platform (Cloud API) and other supported channels. We may add, change, or remove features at any time.
You must be at least the age of majority in your jurisdiction and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials and access tokens, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

We may suspend or terminate access for conduct that we reasonably believe violates these Terms or the policies of Meta or WhatsApp.
Your use of WhatsApp and Meta integrations through the Service is additionally subject to the WhatsApp Business Terms, the Meta Platform Terms, and the WhatsApp Business Messaging Policy. You are responsible for complying with those terms and policies when using the Service.
If you use the Service to message your own customers, you are the party responsible for those communications. You represent and warrant that you have obtained all necessary consents and legal bases to contact your customers, that your message content complies with applicable law and Meta's and WhatsApp's policies, and that you will honor opt-out requests. You will process personal data in accordance with applicable data protection laws, including the GDPR and Brazil's LGPD.
Certain features are provided for a fee. Fees, billing cycles, and plan limits are described at the point of purchase. Charges for WhatsApp conversations and message delivery may be billed directly to you by Meta according to Meta's pricing. Unless required by law, fees are non-refundable. We may change our fees on prospective notice.
The Service, including its software, design, and content, is owned by Smart TI or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the content and data you submit, and you grant us the rights necessary to operate the Service on your behalf.
The Service integrates with third parties, including Meta Platforms, Inc. and WhatsApp. Your use of those services is governed by their own terms, and we are not responsible for third-party services.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that messages will always be delivered.
To the maximum extent permitted by law, Smart TI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Smart TI and its affiliates from any claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or the applicable Meta or WhatsApp policies, or if required by law. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws rules. The courts located in Brazil will have jurisdiction over any dispute, except where applicable law provides otherwise.
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
